The South Asian American Justice Collaborative, in solidarity with leading labor unions, health care organizers, universities and other organizations, has challenged the Trump administration’s imposition of a $100,000 fee on H-1B visas in court. The South Asian American Justice Collaborative says the fee is unconstitutional and economically devastating. The petition, filed in the U.S. District Court for the Northern District of California, argues that the September 19 order, which was implemented 36 hours later, violates the Administrative Procedure Act. By doing so, the Trump administration has illegally usurped Congress’s powers. The petition is co-sponsored by the Global Nurse Force, United Auto Workers International, the American Association of University Professors and the Committee of Internships and Residencies.
